1. Our services

Senior Home Guides is a free service that helps families learn about and compare senior living options, such as independent living, assisted living and in-home care, and connects them with senior advisors. You answer a few questions, and we follow up about your request.

• We don't own, run or recommend any particular senior living community, and we don't provide in-home care or any other care services ourselves.
• We don't guarantee that an advisor will be available in your area, that any community or service will have space or accept your family, or what anything will cost.
• Information on the Site is general. It isn't legal, financial or professional advice, and it isn't a substitute for talking with the communities, providers and professionals involved in your family's decision.
• Senior living communities, advisors and providers are independent businesses. They aren't our employees or agents, and we aren't responsible for what they say, do or charge.
• Families don't pay us.

2. Who can use the Services

You must be at least 18 years old and able to enter into a binding agreement. The Services are meant for people in the United States.

3. The information you give us

You agree that the information you give us is true, current and complete, and that you have the right to give it, including any information about the person you're helping. Please give only the information our questions ask for.

4. Agreeing to be contacted

When you submit your phone number and agree to be contacted, you agree that we may contact you at the number and email address you gave us by phone call and email, including with automated technology and prerecorded or artificial voice, about your request and about senior living options. We send text messages only if you tick one of the separate, optional text message checkboxes (see "Text message terms" below). The exact wording you agree to is shown next to the button you click. You confirm that the phone number is yours or that you're authorized to use it. You don't have to agree to be contacted in order to use the Site or to buy anything, and you can withdraw your agreement at any time as described in our Privacy Policy.

5. Third-party sites and businesses

The Services may link to websites and mention businesses we don't control. We aren't responsible for their content, products, services, prices, availability or privacy practices, and a link or mention isn't an endorsement. Any agreement you make with a community, advisor or provider is between you and them.

6. Our content and trademarks

The Site and its content, including text, graphics, illustrations, logos, the Senior Home Guides name and the software behind it, belong to us or our licensors and are protected by copyright and trademark laws. You may view and print pages for your own personal, non-commercial use. Anything else, including copying, republishing or selling our content, needs our written permission.

If you send us questions, comments, ideas or feedback ("Submissions"), you agree we may use them for any lawful purpose without paying or crediting you.

7. Things you agree not to do

• give false information, or submit information about someone without their permission
• use the Services for anything illegal or unauthorized, or to harass or harm anyone
• use bots, scrapers or other automated tools to access the Services or collect information from them
• try to get around security features, or interfere with or overload the Services
• copy, decompile or reverse engineer the Site's software, except as the law allows
• upload viruses or other harmful code
• impersonate anyone, or misrepresent your relationship with anyone
• use the Services to build a competing product or to advertise your own goods or services

8. Privacy

Our Privacy Policy explains how we collect, use and share information, and it is part of these Terms. The Services are hosted in the United States.

9. Changes, interruptions and ending access

We may change, pause or stop any part of the Services at any time without notice, and we don't promise the Services will always be available or error-free. We may correct mistakes on the Site at any time. We may suspend or end your access if we believe you've broken these Terms or the law.

10. Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T WARRANT THAT THE CONTENT IS ACCURATE OR COMPLETE, AND WE DON'T WARRANT, ENDORSE OR GUARANTEE ANY PRODUCT OR SERVICE OFFERED BY A THIRD PARTY. YOU USE THE SERVICES AT YOUR OWN RISK.

11. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE AND OUR OFFICERS, EMPLOYEES AND AGENTS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE IS LIMITED TO THE LESSER OF THE AMOUNT, IF ANY, YOU PAID US IN THE SIX (6) MONTHS BEFORE THE CLAIM AROSE OR $1,000.00 USD. SOME STATES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT ALL APPLY TO YOU.

12. Indemnification

You agree to defend and hold us harmless, including our affiliates, officers, agents and employees, against any third-party claim, loss or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of the law or of someone else's rights, or information you submit that you didn't have the right to submit.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules.

14. Dispute resolution

Talk to us first. If you have a dispute with us, please email team@seniorhomeguides.com first. We'll both try to resolve it informally for at least 30 days before starting arbitration.

Binding arbitration.If we can't resolve it, the dispute will be decided by binding individual arbitration under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA's Supplementary Procedures for Consumer Related Disputes (adr.org). Your arbitration fees are governed, and where appropriate limited, by the AAA consumer rules. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration may be held by phone, online, on documents or in person, and unless the AAA rules or the law require otherwise, it will take place in Texas.

No class actions. Disputes will be resolved only on an individual basis, not as a class, collective or representative action.

Exceptions. Either of us may go to court for claims about intellectual property or for injunctive relief. If a dispute goes to court for any reason, it will be heard in the state or federal courts located in Texas. Any claim must be brought within one (1) year after the cause of action arose.

15. Electronic communications

You agree to receive notices and records from us electronically, and that electronic agreements, notices and records meet any legal requirement that they be in writing.

If a complaint isn't resolved to your satisfaction, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210 or (916) 445-1254.

17. Miscellaneous

These Terms and our Privacy Policy are the whole agreement between you and us about the Services. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver. We may assign these Terms; you may not without our permission. Nothing in these Terms creates a partnership, employment or agency relationship. We aren't responsible for delays or failures caused by events beyond our reasonable control.

19. Text message terms

Program: Senior Home Guides text messages, operated by Lambda Solutions LLC. The Site asks for two separate, optional consents, and you may agree to either, both or neither. If you tick the non-marketing checkbox, we may send you non-marketing text messages about your senior living request, such as a code to verify your number, call scheduling and appointment reminders. If you tick the marketing checkbox, we may send you marketing text messages that follow up on the senior living options you asked about. Messages may be sent using automated technology.

• You don't have to agree to receive text messages to use the Site or to buy anything.
• Message frequency varies.
• Message and data rates may apply.
• Reply STOP to opt out at any time. You'll receive one confirmation message and no further messages.
• Reply HELP for help, or email team@seniorhomeguides.com.
• Carriers aren't liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. See our Privacy Policy.
